Terms and Conditions of Exotic Life
§ 1 Scope, customer information
The following general terms and conditions regulate the contractual relationship between exoticerleben - ZERTC Global Business GmbH & Co KG and consumers and entrepreneurs who purchase goods via our online shop. We do not recognize any conditions of the entrepreneur that conflict with or deviate from our terms and conditions. The contract language is German.
§ 2 Conclusion of contract
(1) The offers on the Internet represent a non-binding invitation to you to purchase goods.
(2) After entering your data and clicking the order button, you make a binding offer to conclude a purchase contract. You can also place a binding order by telephone or fax. Confirmation of receipt of your order immediately by email or fax does not constitute acceptance of the purchase offer.
(3) We are entitled to accept your offer within 2 days by sending an order confirmation by email. If the deadline specified in sentence 1 has expired without result, your offer is considered rejected, i.e. you are no longer bound to your offer. When ordering by telephone, the purchase contract is concluded if we accept your offer immediately. If the offer is not accepted immediately, you are no longer bound to it.
(4) If you select the payment method “PayPal Express”, the payment is processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: “PayPal”), subject to the PayPal Terms of Use, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-fullor - if the customer does not have a PayPal account - subject to the terms and conditions for payments without a PayPal account, which can be viewed at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full. If the customer selects “PayPal Express” as the payment method as part of the online ordering process, he also issues a payment order to PayPal by clicking the button that completes the ordering process. In this case, the seller declares acceptance of the customer's offer at the time the customer initiates the payment process by clicking on the button that completes the ordering process.
§ 3 Customer information: Storage of the offer text
The contract text with information about the item will be saved by us. You do not have access to the text of the contract via the Internet.
Please note that each discount can only be used once and a combination of several discount promotions is excluded.
§ 4 Customer information: Correction notice
You can correct your entries at any time before placing the order.We will inform you about your correction options as you go through the ordering process.
§ 5 Cancellation policy

Cancellation policy Right of withdrawal You have the right to withdraw from this contract within thirty days without giving any reason. The cancellation period is thirty days from the day on which you or a third party named by you who is not the carrier has or has taken possession of the goods. In the case of a contract for several goods that you have ordered as part of a single order and which are delivered separately, the period begins on the day on which you or a third party designated by you, other than the carrier, have taken possession of the last goods. In the case of a contract for the delivery of goods in several partial shipments or pieces, the period begins on the day on which you or a third party named by you who is not the carrier has or has taken possession of the last partial shipment or last piece. Note on the cancellation policy
The right of withdrawal does not apply to contracts for the delivery of goods that are manufactured according to customer specifications or are clearly tailored to personal needs (Section 312 g Paragraph 2, Sentence 1 No. 1 BGB).
§ 6 Retention of title
The purchased item remains our property until full payment.
§ 7 Limitation of your warranty claims
(1) Warranty to consumers for used goods
Your warranty claims due to defects in used goods expire one year from the handover of the goods thing sold to you. Excluded from this regulation are claims for damages, claims due to defects that we fraudulently concealed, and claims arising from a guarantee that we have given for the quality of the item. The statutory limitation periods apply to these excluded claims.
(2) Warranty to entrepreneurs
Your warranty claims due to defects in the purchased item expire one year from the transfer of risk. Excluded from this regulation are claims for damages, claims due to defects that we fraudulently concealed, and claims arising from a guarantee that we have given for the quality of the item. The right of recourse according to Section 478 of the German Civil Code (BGB) is also excluded. The statutory limitation periods apply to these excluded claims.
§ 8 Limitation of liability
We exclude liability for slightly negligent breaches of duty, provided that these do not concern essential contractual obligations, damages resulting from injury to life, body or health or guarantees or claims under the Product Liability Act. The same applies to breaches of duty by our vicarious agents and our legal representatives. The essential contractual obligations include, in particular, the obligation to hand over the item to you and to provide you with ownership of it. Furthermore, we must provide you with the item free of material and legal defects.
§ 9 Commercial place of jurisdiction
The exclusive place of jurisdiction for all disputes arising from this contract is our place of business if you are a merchant.
